高雄市鄭姓女子四年前蓄意旋開瓦斯鋼瓶閥，再用打火機點火釀民宅氣爆，害自己顏面、四肢有燒燙傷，檢警據高雄市消防局火調報告，依放火燒燬住宅罪嫌起訴鄭女。然而，鄭女不斷辯稱，「不記得案發經過」，鄭父也證稱，女兒長期受思覺失調症所苦，有就醫診斷紀錄，高雄地方特惠組合法院認定鄭女犯案時，出現被害妄想才想輕生，判她無罪，令她入處所施以監護1年。鄭女與舅舅、舅媽同住一屋，卻在四年前10月31日時，將放在一樓客廳茶几旁的瓦斯鋼瓶氣閥開關轉開，讓瓦斯外洩，再點火點燃瓦斯，害民宅氣爆，現場一片慘不忍睹，沙發塑膠皮、電視機外殼全被燒熔，茶几桌板結構也被高溫燒得碳化，幸好氣爆威力不至於讓住宅主結人氣產品過年送禮推薦構損壞。. } }); } 同棟住戶聽聞氣爆聲響，通報高雄市消防局趕抵搶救，涉嫌縱火的鄭女也被依法送辦。鄭女到案辯稱，有聽過父親講述過此事，但已不記得案發經過。鄭女辯護人也辯稱，鄭女受妄想型思覺失調症影響人氣產品網購人氣商品，犯案時欠缺辨識、行為能力，也就沒有責任能力。檢方調查，鄭女案發前曾陸續在家割腕、用刀刺傷胸口，還曾從3樓高處一躍而下，送往高雄榮民總醫院急診救治，發現她出現被害意念，還有視聽幻覺等症狀，經醫院診斷，鄭女疑似有思覺失調症。鄭女在犯案那年9月22日出院，隨後在10月31日縱火，害自己顏面、右上肢、雙下肢有二度燒傷，受傷表面積占全身13%。高雄地方法院認定，鄭女犯案時受被害妄想影響，無法分辨現實與妄想情境，深感無望才萌生自輕生念頭，判她無罪。然而，鄭女行為對他人生命財產有高度危險性，若缺乏適度治療，恐有再犯疑慮；為優惠專區必買及早預防，法官令她持續接受精神評估、治療，並入相當處所施以監護1年，可上訴。高雄市鄭女患思覺失調症，4年前出現被害妄想，旋開瓦斯又點火釀氣爆，高雄地方法院認定她無行為辨識能力，判她無罪，但要施以監護1年。圖／報系資料照 分享 facebook
防偷拍有解？ 婦援會推法遏止
【台灣醒報實習記者王淯意台北採訪報導】偷拍問題層出不窮，婦女救援基金會盼立法促進兩性平等！婦援會17日公布《侵害個人性私密影像防治條例》草案，盼遏阻偷拍不法情事。根據統計，以今年4月為例，關於性私密影像外流的新聞報導就有29件，「這相當於每天就發生一件，而且還不計新聞報導以外的案件，凸顯了私密影像外流的嚴重性與急迫性。」
婦援會在2017年特別成立專法小組，經過1年研擬，完成《侵害個人性私密影像防治條例》的草案。根據該草案，未來未經他人同意，從事偷拍或紀錄他人性私密影像的行為將處以最高5年徒刑；電視、網路媒體任意記載被害人姓名也將處以10萬至100萬元罰鍰。
隨著傳播科技迅速發展，「未經同意散布性私密影像」的問題層出不窮，根據婦援會調查，大多數的受害者仍以女性為大宗。對於「未經同意散布性私密影像」的問題，台灣多以刑法《散布猥褻物品罪》、《誹謗罪》等法條來判刑。
又勝律師事務所律師陳明清 表示，目前刑法的刑度雖然可判2到3年，但實際判決多為6個月以下可易科罰金了事，對加害者根本起不了嚇阻作用。因此研擬《侵害個人性私密影像防治條例》，就未經同意紀錄他人性私密影像的行為處以最高5年的有期徒刑及併科罰金。
「《侵害個人性私密影像防治條例》最重要的是，它參考了《家庭暴力防治法》的保護令制度，提出了『禁制令』」，法律扶助基金會台北分會專職律師朱芳君說，當法院認定個人性私密影像有外流之虞，就可以核發該令。其中禁制令內容包括，命令加害人將持有的私密影像刪除或交付給被害人、要求加害人向網路平台申請刪除外流的私密影像。
朱芳君表示，《侵害個人性私密影像防治條例》特別將網路平台及應用服務提供者、電信業者內入規範內，警察機關在被害人報案且受理後24小時內，應通知業者移除網頁內容，業者也須全力配合。若業者不願配合，將處以20萬至100萬元罰鍰。電視、網路等媒體也不得報導或記載被害人姓名或足以辨識其身份的資訊，業者若違法將處以10萬至100萬元罰鍰。
對於該條例的立法進程，范情表示，8月6日會先在立委尤美女辦公室舉辦首場公聽會。
